1. Introduction and Legal Scope
Welcome to Boat4You! These Terms and Conditions ("Terms") form a legally binding agreement between you ("User" or "you") and Boat4You ("Boat4You," "we," "us," or "the Company"). Boat4You is a company registered in Croatia, and it operates internationally as an online yacht charter platform connecting clients with verified yacht providers. By accessing or using the Boat4You website, mobile application, and related services (collectively, the "Platform"), you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Platform.
These Terms apply to all visitors, Users, and others who access the Platform, including individuals searching for and booking yacht charters ("Clients") as well as yacht owners or operators listing their boats for charter ("Yacht Providers"). Additional terms and policies (such as our Privacy Policy) may apply alongside these Terms; in case of conflict, these Terms take precedence regarding use of the Platform.
Please read these Terms carefully to understand your rights and obligations. The scope of these Terms includes rules for using the Platform, the nature of Boat4You's services as an intermediary, and important disclaimers and legal provisions under Croatian law. If you have any questions about these Terms, please contact us using the information in Section 14.
2. Definitions
For clarity, here are key terms used throughout these Terms (all capitalized terms have the meanings defined below):
- "Platform" -- The Boat4You website (Boat4You.com), mobile applications, and any services or tools provided by Boat4You that enable Users to list, find, or book yacht charters.
- "Boat4You" (also "Company" or "we/"us") -- Boat4You d.o.o., the Croatian-registered company that owns and operates the Platform.
- "User" or "you" -- Any person or entity using the Platform in any manner, including Clients and Yacht Providers.
- "Client" -- A User who uses the Platform to search for, book, or charter a yacht (also referred to as a renter or charterer).
- "Yacht Provider" -- A User (individual owner, charter company, or authorized agent) who lists and offers yachts for charter through the Platform. Yacht Providers are independent third parties not employed by Boat4You.
- "Listing" -- An online listing on the Platform created by a Yacht Provider, describing a yacht available for charter, including details like boat specifications, amenities, pricing, availability, and any special terms.
- "Booking" -- A reservation for a specific yacht charter made by a Client through the Platform. A Booking is confirmed when a Yacht Provider accepts a Client's request and payment is processed.
- "Charter Contract" -- A separate rental or charter agreement between the Client and the Yacht Provider for the use of the yacht (often signed at check-in). This contract outlines the rights and responsibilities for the actual yacht rental period. Boat4You is not a party to the Charter Contract.
- "Services" -- All services provided by Boat4You via the Platform, including but not limited to enabling the creation of Listings, facilitating communication and payments between Clients and Yacht Providers, and providing customer support.
- "Content" -- All text, photos, reviews, ratings, communications, and other materials that can be viewed on, uploaded to, or otherwise made available through the Platform. This includes content provided by Users (e.g., boat descriptions by Yacht Providers or reviews by Clients) and content provided by Boat4You (Platform design, articles, etc.).
The above definitions are provided to help interpret the Terms. Additional definitions may appear elsewhere in these Terms.
3. Use of the Platform and User Eligibility
By using Boat4You's Platform, you represent and warrant that you meet the following eligibility criteria and agree to the usage rules below:
- Minimum Age: You are at least 18 years old (or the age of legal majority in your jurisdiction) and capable of entering into legally binding contracts. The Platform is not intended for use by minors.
- Accurate Information: You agree to provide true, current, and complete information about yourself when creating an account or making a Booking. This includes personal identification details, contact information, and any qualifications (e.g., boating licenses) if required. You will update your information to keep it accurate.
- Account Security: If you create an account, you are responsible for maintaining the confidentiality of your login credentials. All activities that occur under your account are your responsibility. Notify us immediately at our contact email (Section 14) if you suspect any unauthorized access or security breach.
- Legitimate Use: You agree to use the Platform only for its
intended purpose of connecting with Yacht Providers for yacht
charters. You will not misuse the Platform or engage in any activities
that are fraudulent, violate any laws, or infringe on anyone's rights.
This means you shall not do any of the following:
- Post false, misleading, or defamatory information.
- Use the Platform to transmit any harmful code, viruses, or harassing messages.
- Attempt to circumvent the Platform's system or fees (for example, by contacting a Yacht Provider you found on Boat4You to book outside the Platform). All bookings of yachts found through Boat4You should be completed through Boat4You for your security and to ensure our support.
- Engage in scraping, data mining, or use automated systems to extract data from the Platform without our prior written permission.
- Compliance with Laws: You will comply with all applicable laws and regulations in connection with your use of the Platform and any yacht charter booked through Boat4You. This includes local boating laws in the destination of your charter (such as rules on required licenses, navigation, environmental protection, customs and immigration if you sail to different countries, etc.).
- No Third-Party Rights Abuse: You agree not to use the Platform in a manner that infringes or violates the rights of any third party, including intellectual property rights and privacy rights of others.
Boat4You reserves the right to suspend or terminate your account or access to the Platform if we believe, in our sole discretion, that you have violated these Terms or any applicable law. We also reserve the right to refuse service, cancel bookings, or remove content for any User that abuses the Platform or engages in inappropriate or illegal conduct.
By using the Platform, you acknowledge that any arrangement facilitated through Boat4You is at your own risk. We simply provide a platform for Yacht Providers and Clients to connect --- usage of the Platform does not establish Boat4You as a yacht owner, charter operator, or as your agent beyond the intermediary services described. Your acceptance of these Terms signifies that you understand this relationship and agree to abide by all rules of Platform use and eligibility requirements stated above.
4. Nature of Service -- Intermediary Role of Boat4You
Boat4You is an intermediary platform that brings together Clients and independent Yacht Providers. It is important to understand the following about the nature of our services:
- No Ownership of Yachts: Boat4You does not own, manage, or operate any of the yachts listed on the Platform. The yachts are owned and provided by third-party Yacht Providers who are independent businesses or individuals. Boat4You is not a charter company or boat operator; we do not maintain or crew the boats. Our role is solely to facilitate the initial contact, booking, and payment between Clients and Yacht Providers.
- No Party to Charter Contract: When a Client makes a Booking for a yacht, they will typically enter into a separate Charter Contract (rental agreement) directly with the Yacht Provider at or before the time of check-in. Boat4You is not a party to that contract and has no control over the Yacht Provider's fulfillment of the charter. Any issues, liabilities, or disputes arising from the actual use of the yacht (such as boat condition, performance, accidents, etc.) are primarily between the Client and the Yacht Provider, as governed by their Charter Contract and applicable law.
- Verified Yacht Providers: Boat4You strives to feature verified Yacht Providers on our Platform. "Verified" means we may have conducted certain checks (e.g., validating a provider's identity, confirming boat documentation or insurance, requiring a minimum standard of service, or relying on user reviews). However, verification is not a guarantee or warranty of the condition of the boat, the accuracy of the Listing, or the Yacht Provider's performance. The Yacht Provider is solely responsible for the content of their Listings and for providing the charter services.
- Platform Content and Information: We aim to keep information on our Platform (Listings, availability, pricing, descriptions) as accurate and up-to-date as possible. However, this information is primarily provided by Yacht Providers. Boat4You does not guarantee that any Listing content (including boat specifications or availability) is error-free or 100% accurate. Clients should communicate with the Yacht Provider through the Platform to confirm any specific details that are critical to them.
- No Endorsement: The inclusion of any Yacht or Yacht Provider on Boat4You's Platform does not mean we endorse or certify them beyond facilitating the listing. We do not make any promises about the safety, suitability, or legality of any specific yacht or charter. It is the responsibility of the Yacht Provider to ensure the yacht meets all safety and legal requirements, and it's the Client's responsibility to exercise due diligence and ask questions when in doubt.
- Intermediary Liability Limitations: Since Boat4You is acting only as a booking intermediary, our liability is limited (see Section 9 for detailed disclaimers). In general, we are responsible for providing the Platform services as described in these Terms, but we are not responsible for the actual sailing experience or outcomes of the charter. For example, Boat4You is not liable for injuries, property damage, or other incidents that occur on board the yacht or during the charter --- those issues must be addressed by the parties directly involved (the Client, the Yacht Provider, and their insurers).
- Payments Facilitation: Part of our intermediary role is to facilitate payments from Clients to Yacht Providers. While we may accept and hold funds on behalf of Yacht Providers (see Section 6), this is solely to streamline the booking process. Boat4You does not provide insurance or banking services; any funds collected that are due to the Yacht Provider will be remitted to them per our agreement with the provider. We may deduct our commission or fees before remitting funds.
- No Travel Package or Transport Provider: Unless explicitly stated, Boat4You is not organizing travel packages or acting as a transport provider. We do not provide flights, on-land accommodations, or travel arrangements aside from the yacht charter booking itself. Any additional services (like skipper hire, provisions, excursions) may be offered by the Yacht Provider or third parties and are not part of our service unless specified.
In summary, Boat4You's service is limited to connecting you with a Yacht Provider and facilitating your booking. We want you to have a fantastic and safe experience on your charter, and we work hard to list reputable providers. However, the ultimate responsibility for delivering the charter service lies with the Yacht Provider, and the Client and Yacht Provider will be bound by their own agreement. Always make sure you understand the Yacht Provider's terms (such as their safety rules, insurance coverage, and cancellation policy) in addition to the Platform Terms herein.
5. Booking Process and Confirmations
Boat4You's Platform is designed to make the yacht charter booking process smooth and transparent. Below is an overview of how the booking process works and what to expect:
5.1. Searching and Inquiries: Clients can browse yacht Listings by destination, date, boat type, or other criteria. Each Listing provides details about the yacht (specifications, capacity, amenities), availability dates, pricing, and any specific conditions from the Yacht Provider. If you have questions, you can use the Platform's messaging system to contact the Yacht Provider before booking. Yacht Providers are encouraged to respond promptly with accurate information.
5.2. Requesting a Booking: When you've found a suitable yacht, you can initiate a booking request. Depending on the Listing, the booking might be:
- "Instant Book" -- where your booking is automatically confirmed upon payment, without waiting for provider approval (usually available for providers who enabled immediate confirmation); or
- "On Request" -- where your booking request is sent to the Yacht Provider for approval. The provider typically must accept or decline within a specified time (e.g., 24-48 hours), as indicated during the booking process.
During the request, you will need to enter relevant details (dates, number of guests, any extras you want to add, etc.). Review all details carefully -- dates, total price, included services, and any additional fees (for example, cleaning fee, skipper fee if you request a skipper, fuel policy, security deposit amount, etc.) -- before proceeding to payment.
5.3. Payment and Confirmation: To finalize a booking request, the Client will be prompted to provide payment information and pay the required amount (see Section 6 for pricing and payment terms). The payment at booking may be a deposit or the full rental price, depending on the Yacht Provider's policy and how far in advance the booking is made. When using our Platform payment system, your payment will be processed securely. If the booking is "Instant Book," your payment is processed immediately and the booking is confirmed right away. If the booking is "On Request," your payment method may be authorized or charged a deposit, but the booking will remain pending until the Yacht Provider accepts.
- Provider Acceptance: If your booking was on request, once you submit the booking request and payment, the Yacht Provider will be notified. If the Yacht Provider accepts your request, Boat4You will send you a Booking Confirmation email or notification. At that point, your payment will be captured (if it wasn't already) and a binding agreement for the charter is in place between you and the Yacht Provider. If the Yacht Provider declines or does not respond in time, the request will expire or be canceled, and any payment authorization will be released or refunded to you (you won't be charged for unconfirmed bookings).
- Booking Confirmation: The confirmation will include important details such as the Yacht Provider's contact information, the exact location and time for check-in (boarding), check-out details, and any next steps. It is your responsibility to review the confirmation details and reach out promptly if anything is incorrect or unclear.
5.4. Charter Documents and Requirements: After confirmation, the Yacht Provider or Boat4You may contact you for additional information or to provide important documents:
- You may be asked to fill out a crew list, providing names, ages, and passport/ID details of all passengers who will be on board. This is often required by maritime law and port authorities, especially in countries like Croatia, and must be completed before the charter begins.
- If you indicated that you will be the skipper (operating a bareboat charter), you will be required to provide proof of your boat license (skipper qualification) and any radio license (if applicable) ahead of time or at check-in (see Section 8 on User Responsibilities). Failure to provide valid license documents can lead to cancellation at check-in with penalties.
- The Yacht Provider might send you a charter agreement or ask you to sign their Charter Contract. You should read this document carefully, as it will detail the specific terms of the yacht rental (such as insurance, security deposit conditions, liability for damage, and local rules). If you have questions about it, ask the Yacht Provider or Boat4You before the charter date.
5.5. Check-In and Handover: On the day of your charter start, you will meet the Yacht Provider (or their base staff) at the designated marina or harbor for check-in. At check-in:
- You will likely need to present your identification (passport or ID card) and the original skipper's license (if you're sailing yourself).
- The Yacht Provider will often require a security/damage deposit (usually a credit card hold or cash, see Section 8) which is standard in yacht charters to cover potential damages or losses.
- You and the Yacht Provider (or a skipper/representative) will do a boat inspection together. They will show you the boat's systems, inventory, and note any pre-existing damages on a checklist. Both parties may sign this checklist or handover form to confirm the boat's condition at the start.
- If you have hired a professional skipper or crew through the Yacht Provider, you'll likely meet them and clarify the itinerary or any preferences.
After these steps, you'll be handed the keys or be given command of the vessel, and your adventure begins!
5.6. During the Charter: Enjoy your time on the water, but remember to adhere to the agreed rules:
- Follow any navigation limits or permitted sailing areas as instructed by the Yacht Provider (some charters may restrict you from leaving certain regions without permission).
- Adhere to safety rules and good seamanship practices. Treat the yacht with care as if it were your own.
- If any issues arise with the boat's operation or if an incident occurs (mechanical problems, accident, injury, etc.), contact the Yacht Provider immediately for guidance. Boat4You's support team is also available to assist or advise if needed, but the Yacht Provider is usually best positioned to help with on-site issues.
5.7. Check-Out and Return: At the end of your charter period, you must return the yacht at the agreed time and place:
- The Yacht Provider will inspect the yacht for any new damage, missing equipment, or abnormal cleaning requirements.
- The checklist from check-in will be reviewed and any new damages should be noted. Normal wear and tear or minor issues might be covered by the Yacht Provider's insurance, but any significant damage or losses that occurred during your charter and were caused by you or your crew may be deducted from your security deposit (or otherwise charged to you, if costs exceed the deposit).
- If everything is in order, the security deposit is returned (unblocked on your card or cash handed back) according to the Yacht Provider's procedures.
- If fuel policy requires, ensure the yacht's fuel and water tanks are refilled as provided at the start (or as per the agreement, e.g., "full-to-full" policy).
- Finally, don't forget to take all your personal belongings from the yacht.
5.8. Reviews: After the trip, you will have the opportunity to leave a review of the Yacht Provider and the overall charter experience on Boat4You. We encourage honest and constructive feedback, as it helps maintain quality on our Platform (see Section 10 on Reviews and User Content).
5.9. Support: Boat4You's customer support is available to assist you through the booking process. If at any point you encounter technical issues with the Platform, or if a Yacht Provider is unresponsive or you face an urgent problem, contact us. While the primary contract is between you and the provider, we are here to facilitate communication and help mediate common issues (for instance, a last-minute cancellation by a provider, or a dispute over charges). We want both Clients and Yacht Providers to have a smooth experience, and we'll do our best to assist within the limits of our role.
By following the above process and paying attention to details, you can ensure your yacht charter booking via Boat4You goes as smoothly as possible. If you have any questions about how booking works, please refer to our FAQs or reach out to our support team.
6. Prices and Payment Terms
Boat4You aims to provide transparent pricing so you know exactly what you're paying for. This section explains how prices are set, what is included, how payments are handled, and related terms:
6.1. Pricing of Charters: Prices for yacht charters are primarily set by the Yacht Providers. Each Listing will display the charter price, typically as a daily or weekly rate, or a total price for the selected dates. Prices may vary based on season, duration of charter, type of boat, or special events. We strive to show all mandatory charges up front. In a Listing or during checkout, you may see the following components:
- Charter Price: The base price for renting the yacht for the specified period.
- Boat4You Service Fee (if applicable): A fee charged by Boat4You to the Client for use of our Platform services. This fee (if charged) helps us operate the Platform and provide customer support. It will be clearly itemized at checkout if applied. In many cases, our commission is taken from the Yacht Provider's side, but if any fee is charged to you, it will be disclosed.
- Included/Excluded Items: The Listing should state what is included in the price (for example, use of the boat, standard equipment, safety gear, final cleaning, etc.) and what is excluded (for example, fuel, marina fees, tourist taxes, optional skipper or crew, provisioning, etc.). You are responsible for any costs not explicitly included. Always review the Listing details and ask the Yacht Provider if you are unsure about any charges.
- Taxes: Depending on the location and the Yacht Provider's status, VAT or other taxes may be applicable. If a tax is included or added, it will be shown before you confirm payment. (For charters in Croatia, typically VAT is applied to charter fees; if it's included in the price, the Listing might say so.)
- Security Deposit: The required security deposit amount (see Section 8) might be mentioned in the Listing, but note that this deposit is usually not collected by Boat4You at the time of booking. It is typically handled offline at check-in by the Yacht Provider. The Listing will state the amount and method (e.g., €2,000 via credit card hold).
- Optional Extras: Many Yacht Providers offer optional extras (e.g., hiring a skipper or hostess, water sports equipment, airport transfers, etc.). These may be selectable during booking or arranged later. Some extras might be paid in advance via the Platform, while others might be payable in cash on arrival. The Listing or booking form should clarify this.
6.2. Currency: Boat4You may display prices in various currencies for your convenience, but by default, pricing will often be in Euros (EUR) or the local currency of the charter destination. The currency and total amount due will be confirmed at checkout. If you choose to view prices in a different currency, be aware that exchange rate fluctuations might affect the final charge if your payment method operates in another currency. Your bank or card provider might charge currency conversion fees, which are your responsibility.
6.3. Payment Methods: We support secure payment methods including major credit/debit cards and possibly other methods (like bank transfers or online payment services) as listed on our Platform at checkout. By providing your payment details, you authorize Boat4You or our third-party payment processor to charge the specified amount for your booking. All payment information is processed securely, and Boat4You does not store your full card details on our servers.
6.4. Payment Schedule: The timing of payment collection depends on how far in advance the booking is made and the Yacht Provider's payment policy:
- For bookings made well in advance (e.g., more than a few weeks or months before the charter start), often a deposit (such as 30-50% of the total price) is charged at the time of booking confirmation, and the balance is due closer to the charter date (for instance, 30 days before departure, or upon arrival). The exact schedule will be communicated during booking. Boat4You may facilitate scheduling of the second payment or provide instructions if part of the payment is to be made directly to the Yacht Provider at check-in.
- For short lead time bookings (e.g., made a week or a few days before the start date) or small rental durations, the full amount might be due upfront when booking is confirmed.
- You are responsible for making all payments by the deadlines provided. If a second payment (balance) is due later and you fail to pay by the due date, Boat4You and/or the Yacht Provider reserve the right to treat it as a cancellation by you, which could result in loss of the booking and be subject to cancellation penalties (see Section 7).
6.5. Booking Confirmation and Receipts: Once your payment (or initial deposit) is successfully processed and the booking is confirmed by the Yacht Provider, you will receive a confirmation email/receipt summarizing the paid amount and any remaining amount due (if applicable). If Boat4You collects the full charter fee on behalf of the Yacht Provider, we will also provide a payment receipt for the total. Yacht Providers may also provide their own invoice or receipt at check-in, especially if local regulations require it.
6.6. Payment Processing and Security: Boat4You uses reputable third-party payment processors to handle transactions (such as credit card gateways or PayPal, etc.). All transactions are encrypted and secure. However, you should also do your part: only make payments through the official Platform interface. Boat4You will never ask you to pay by wire transfer to a personal bank account or in cash through unofficial channels for the initial booking. If anyone (including a Yacht Provider) asks you to pay outside the Platform for a reservation, notify us immediately, as that may be a violation of these Terms and could be unsafe. For any payments that Boat4You does not process (like the security deposit or on-site extras), Boat4You is not responsible for those transactions -- they are between you and the Yacht Provider, but you should always insist on a receipt and be cautious.
6.7. Price Accuracy and Errors: We do our best to avoid errors in pricing. If we discover a pricing error for a confirmed booking (e.g., a boat was listed at an obvious incorrect rate due to a typo or technical glitch), we will inform you as soon as possible. Neither we nor Yacht Providers are obligated to honor bookings at erroneous prices. In such a case, we (or the Yacht Provider) may offer you the option to pay the correct price or cancel the booking for a full refund. Similarly, if new taxes or legal charges are introduced that affect the price (rare, but for instance a new tourist tax implemented after booking), we will let you know the options.
6.8. Promotions and Discounts: Boat4You or the Yacht Providers may occasionally offer promotional codes, discounts, or special offers. Each such promotion will have its own terms (validity period, conditions, etc.). Generally, promotional discounts apply to the charter price or Boat4You fees and cannot be redeemed for cash. If you cancel a booking that was made with a promo code, the treatment of the discount will follow the promo terms (often, promotional values are not refundable or may be forfeited).
6.9. Refunds: Any refunds due to you (whether from cancellations as per Section 7 or other cases) will be processed by Boat4You back to the original payment method whenever possible. The timing of refunds can vary depending on your bank or card issuer (typically 5-10 business days for cards). Boat4You's service fees (if charged) may be non-refundable, except in cases of provider cancellation or error (we will clarify this in Section 7). We will communicate with you regarding any refund transaction. If you paid via bank transfer, we'll arrange a return transfer; you might need to provide bank details and note that bank fees (if any) are your responsibility.
6.10. Late or Failed Payments: If your payment method is declined or a scheduled payment fails:
- For initial bookings: Your booking request may not be completed or could be canceled. You'll need to provide a valid payment method to proceed.
- For balance payments: We will notify you and give a short grace period to pay. If payment isn't received within the given time, your booking may be canceled and subject to the cancellation terms for non-refundable portions.
- We are not responsible for any additional charges you incur from your bank or card provider due to processing the payment (e.g., overdraft fees, foreign transaction fees).
By making a booking on Boat4You, you agree to the pricing and payment terms above. Please ensure you have sufficient funds and understand all financial obligations before confirming a reservation. If anything is unclear about pricing or payment, contact us or the Yacht Provider before you pay, so we can clarify.
7. Cancellations and Modifications
We understand that plans can change. This section describes how cancellations and changes (modifications) to bookings are handled on Boat4You, both from the Client's side and the Yacht Provider's side, as well as situations like force majeure. It's crucial to review the specific cancellation policy for your yacht charter during the booking process (often stated in the Listing or confirmation), as those terms will apply in addition to the general guidelines below.
7.1. Cancellation by Client (You): If you need to cancel a confirmed booking, the following generally applies:
- Cancellation Policy: Each Yacht Provider may set their own cancellation terms (e.g., Flexible, Moderate, Strict). These policies outline what refund (if any) you are entitled to based on how far in advance of the charter start date the cancellation occurs. For example, a policy might state: "Free cancellation up to 30 days before check-in; 50% refund up to 7 days before; no refund if less than 7 days." Boat4You will display or include the applicable cancellation policy at the time of booking and in your confirmation.
- Boat4You Service Fee: In many cases, the Boat4You service fee (if a separate fee was charged) is non-refundable if you cancel, because it covers the services already rendered by our Platform. However, if you cancel far in advance, we may refund the service fee at our discretion or if required by the specific promotion terms.
- Process: To cancel, you should use the Platform's cancellation function in your account dashboard or request a cancellation via email to Boat4You support. The date and time we receive your cancellation request will determine the effective cancellation time (all times are calculated based on the local time of the yacht's location, unless stated otherwise).
- Refunds: If you are entitled to a refund according to the policy, Boat4You will process the refund to your original payment method. If you only paid a deposit, and you cancel within a time that triggers a penalty greater than that deposit, you may be charged up to the full cancellation fee (we will inform you if that's the case). For example, if you paid a 30% deposit and then cancel last-minute with a 100% penalty policy, you may not get the deposit back, and no further charge will occur since the provider just keeps the deposit. But if you had paid 30% and policy says 50% penalty, we might retain that 30% and charge an additional 20% to fulfill the 50% due to the provider.
- No-Shows: If you simply do not show up at the agreed check-in time and location without formal cancellation, it is treated as a last-minute cancellation on your part. The Yacht Provider is likely entitled to keep the full amount and may even continue to hold the boat for you for a short period on the start day, but if you fail to arrive, no refund is given. Always communicate if you're running late or cannot make it.
7.2. Cancellation by Yacht Provider: In the rare event that a Yacht Provider cancels your booking (or fails to provide the yacht as agreed):

- Alternative Options: Boat4You will make reasonable efforts to assist you in finding a similar alternative charter for the same dates. We have a network of providers and will try to help, but especially in peak season or for specific boat types it might be challenging. Any alternative offered may come with a different price; you can choose whether to accept a rebooking or take the full refund.
- Provider Penalties: We monitor provider cancellations closely. Providers who cancel bookings may face penalties (such as lower listing ranking or removal from our Platform after repeated incidents), as it causes inconvenience to clients. This doesn't directly affect your rights, but it's good to know we discourage last-minute cancellations by providers.
- No Further Liability: While we refund your money and try to help find alternatives, Boat4You is not liable for any additional costs you incur due to a provider's cancellation (like flight changes, accommodation, etc.). We recommend always having travel insurance for such unforeseen events (see Section 9).
7.3. Changes and Modifications by Client: If you want to modify your booking (for example, change dates, pick a different boat, or add extra services):
- Date/Boat Changes: Changing the dates or the yacht is essentially a new booking. If you request a date change, it's subject to availability and the Yacht Provider's approval. If approved, there might be a price difference (e.g., different season rates or a different yacht's cost). If you switch to a higher-priced option, you'll need to pay the difference; if lower, you may get a partial refund depending on timing and provider policy. If the provider cannot accommodate the change, you may have to keep the original booking or proceed to cancel (which would then follow the cancellation policy).
- Minor Adjustments: Some changes like adding an extra day, changing the start time slightly, or adding optional extras (like requesting a skipper or provisioning) can often be done by contacting Boat4You support or the Yacht Provider. We'll help adjust the booking and let you know of any additional cost. It's usually easier to add to a booking than to remove; if you remove a paid extra service, it might be treated as a partial cancellation of that service.
- Changing Guest Count: If you want to increase the number of guests (within the boat's capacity) or change passenger names, you should inform the Yacht Provider ahead of time (for crew list purposes). There usually isn't a fee for minor guest count changes unless it involves reaching a threshold that requires a larger crew or changes the price (rare). However, never exceed the maximum number of passengers allowed on the yacht as per its Listing and safety rules.
- Process for Modification: Contact our support team or the Yacht Provider with your modification request. Significant changes will be handled through the Platform so there is a record (often we'll cancel the original booking by mutual agreement and create a new one, or we'll issue an addendum to the booking terms).
- Note on Timing: If your charter is soon (e.g., in a few days) and you request a major change, it might be too late to modify or the provider may treat it as a cancellation. Always try to request changes as early as possible.
7.4. Weather and Force Majeure: Boating plans are subject to weather conditions and other events outside of anyone's control:
- Unsafe Weather: If there are officially declared unsafe sailing conditions (e.g., a hurricane, gale warnings, port authority closures) on the day of your departure, Yacht Providers will typically postpone departure until it's safe. If it's a short charter (like a day charter) and weather forces a cancellation, the provider may offer a reschedule or refund. For longer charters, a delay of a day might be accommodated with an extended return time if possible. The exact handling can vary; some Charter Contracts have clauses for weather delays.
- Force Majeure Events: Neither Boat4You nor the Yacht Provider is liable for failures to fulfill commitments due to extraordinary events or circumstances beyond their control (so-called "force majeure" events). These include natural disasters, war, acts of God, epidemics/pandemics, government restrictions, or other extreme events making performance impossible or impractical.
- Policy for Force Majeure: In case of force majeure, refunds or credits may be handled on a case-by-case basis. Boat4You will strive to facilitate a fair outcome (such as rescheduling the charter to a later date or providing a credit for future use), but specific local law or Charter Contract terms may apply. We encourage you to have travel insurance that covers trip cancellations or interruptions due to such events.
7.5. Yacht Unavailability or Substitution: If a specific yacht becomes unavailable (due to mechanical breakdown, damage by a previous renter, etc.) but the Yacht Provider offers a substitute yacht of similar size and standard:
- You will be informed ahead of time. If the substitute is reasonably comparable or better (same class or an upgrade) and at no extra cost, most Charter Contracts and terms consider the booking fulfilled. If you strongly object to the substitute (for valid reasons, like it has significantly different features), you can discuss with the provider or Boat4You to find a solution (possibly a refund if no agreement).
- If the only available substitute is of lower standard or smaller, the provider should refund you the difference in price or you can choose to cancel for a full refund.
- Boat4You will assist in these communications to make sure you're satisfied or fairly treated.
7.6. How to Avoid/Minimize Cancellation Issues:
- Before booking, double-check all details (dates, boat specs, policies) to avoid needing changes.
- Consider Cancelation Insurance or Travel Insurance: Independent insurance policies are available that can protect your trip cost if you need to cancel for covered reasons (like illness). These are separate from Boat4You and not offered by us, but we recommend looking into them for expensive charters or complex travel plans.
- Communicate early: If something comes up, let the Yacht Provider or us know immediately. The more advance notice, often the more flexibility in finding a solution.
In all cases of cancellation or changes, Boat4You's role is to facilitate the process according to these Terms and any policies in place. We aim to be fair to both Clients and Yacht Providers, aligning with the agreed rules. Always refer to the specific cancellation policy provided in your booking details, as that will be the primary basis for any refunds or charges. If you have any questions about a cancellation policy before booking, please ask us.
8. User Responsibilities (Client Obligations)
When you book and embark on a yacht charter through Boat4You, you are taking on certain important responsibilities. These responsibilities exist to ensure a safe, legal, and enjoyable experience for everyone involved (you, your guests, the Yacht Provider, and any crew). By confirming a Booking, you agree to the following obligations:
8.1. Legal Qualifications and Documentation:
- Skipper's License: If you are chartering a bareboat (without a
professional skipper) and intend to skipper the yacht yourself, you
must hold a valid skipper's license or certification appropriate
for the size and type of vessel and the waters in which you will sail.
For example, in many countries (including Croatia and other EU
destinations), an ICC (International Certificate of Competence) or
equivalent national license is required for bareboat charters. You are
responsible for checking the specific licensing requirements of the
charter location. If a radio operator's license (VHF/SRC certificate)
or any other certification is legally required, you must have that as
well. You agree to send copies of these licenses to the Yacht Provider
or Boat4You when requested, and present the originals at check-in.
- No License? Hire a Skipper: If you do not have the required
qualifications, you must inform the Yacht Provider in advance and
hire a professional skipper (usually available for an additional
fee). Do not attempt to take a boat out without proper licensing; the Yacht Provider has the right (and legal obligation) to refuse handover of the yacht to an unqualified person, with no refund in such case.
- No License? Hire a Skipper: If you do not have the required
qualifications, you must inform the Yacht Provider in advance and
hire a professional skipper (usually available for an additional
- Crew List and Passports: You must provide a complete and accurate list of all passengers (crew list) to the Yacht Provider by the deadline given (often a week or more before departure, or at booking for last-minute reservations). Include full names, dates of birth, nationalities, and passport or ID numbers as required. This is crucial for legal and safety reasons. All passengers should carry a valid passport or government-issued ID during the charter, especially if traveling through different countries' waters.
- Visas and Travel Permits: Ensure that you and your passengers have any necessary visas or travel documents if your charter will cross into other countries' territories. Boat4You and the Yacht Provider are not responsible for obtaining visas or for any denial of entry.
- Personal Health and Safety Requirements: You should consider whether you and your guests are physically able to participate in the planned boating activities. Disclose any important medical conditions to your companions or hired skipper (for safety, e.g., epilepsy, severe allergies, etc.). While you generally don't need to inform the Yacht Provider of personal medical conditions, you undertake that you (and your guests) are not knowingly putting yourselves in danger by going on the trip (for instance, if someone cannot swim or has mobility issues, ensure proper precautions like life jackets, harnesses, or discuss with the provider if the trip is appropriate).
8.2. During the Charter -- Conduct and Safety:
- Follow Laws and Regulations: You must adhere to all local maritime laws, navigation rules, and regulations of ports and marinas. This includes speed limits, no-go zones, fishing or diving regulations, customs and immigration procedures if crossing borders, and environmental protection laws (such as proper waste disposal and respecting protected areas).
- Good Seamanship: If acting as skipper, you have a duty to operate the yacht prudently and with respect for the sea, weather, and others on the water. Even if you are not the skipper (for example, you hired one), you and your party should cooperate with the skipper and follow their instructions for safety.
- No Unauthorized Passengers or Subchartering: Only the persons listed on the crew list are allowed on board during the charter. You cannot bring additional people or swap out guests mid-charter without the Yacht Provider's permission (except in emergencies). You may not re-rent or subcharter the yacht to anyone else, or use it for commercial purposes (e.g., taking paying passengers) unless explicitly agreed by the Yacht Provider with proper licenses in place.
- No Illegal or Hazardous Use: You must not use the yacht for any illegal purposes (such as transporting contraband, illegal fishing, etc.) or for any activities that could be hazardous. Carrying weapons or illegal drugs on board is strictly prohibited. Do not engage in unsafe behavior like excessive alcohol or drug use that could endanger anyone on board or the vessel. Always ensure at least one responsible person is in charge of the boat who is not impaired.
- Care for the Yacht: Treat the yacht and all equipment with care.
This means:
- Use the yacht's equipment and systems according to instructions (if you're unfamiliar, ask the Yacht Provider or skipper for a briefing).
- Keep the yacht reasonably clean and return it in the same general condition as you received it (aside from normal wear). Excessive cleaning costs due to spilled liquids, stains, trash left onboard, etc., might be deducted from your deposit.
- Do not make any changes or modifications to the yacht (e.g., don't drill holes, install hardware, etc.).
- Use proper fuel if you need to refuel (the Yacht Provider will inform you of the correct fuel type).
- If sailing, adjust sails in a timely manner to avoid gear damage; if motoring, ensure the engine is monitored (check temperature, oil as advised) and not run in prohibited ways (for instance, most charters prohibit towing other vessels or running aground intentionally).
- Respect for Crew and Others: If you have hired crew (skipper, host/hostess, cook, etc.), treat them with respect and follow their safety instructions. They are there to ensure you have a safe trip. Likewise, be courteous to other vessels, follow collision avoidance rules, and respect quiet hours in marinas/anchorages.
8.3. Reporting Issues and Incidents:
- Damage or Loss: If any damage to the yacht or loss of equipment occurs during your charter (no matter how minor), you must inform the Yacht Provider as soon as possible. Early communication can often reduce misunderstandings and allow for quick fixes. Even if it's something like a broken glass or a torn sail, letting the provider know promptly is important.
- Mechanical Problems: If the boat experiences a mechanical failure or system issue, notify the Yacht Provider immediately. Many providers have support networks or can direct you to the nearest port for assistance. Do not attempt a major repair without the provider's approval (small troubleshooting like changing a lightbulb or fuse is fine if you are comfortable).
- Accidents and Emergencies: In the event of a serious incident
(collision, grounding, injury, etc.):
- Ensure all persons are safe and, if necessary, call the appropriate emergency services (mayday calls on radio Channel 16, coast guard, etc.).
- Inform the Yacht Provider and Boat4You as soon as practicable once immediate danger has passed.
- Follow any instructions from local authorities. If there's injury or third-party property damage, you'll often need to file a formal report with the local port authority or police. Get copies of any reports or witness contacts for insurance purposes.
- Do not admit liability on the spot or make promises to third parties; just focus on safety and reporting. The Yacht Provider's insurance (or your own insurance) will handle determining fault and coverage.
- Continued Safety Obligation: Always maintain an adequate watch and safe operation of the vessel. Weather can change rapidly; you should check forecasts regularly and heed any warnings. If you're advised by your hired skipper or local authorities to return to port or seek shelter due to weather, you must do so.
8.4. Return of the Yacht:
- Punctual Return: Return the yacht at the agreed time and location. Late returns can significantly impact the next charter and may result in additional fees. If you are facing a delay (due to weather or other circumstances beyond your control), inform the Yacht Provider as soon as possible. There may be a grace for genuine weather delays, but if you simply return late without a valid reason, late fees could be charged (often specified as an hourly rate or an extra day's charge) and possibly taken from your deposit.
- Same Condition: As noted, return the yacht in the same condition
as received, aside from normal usage. This means:
- The yacht should be reasonably clean (pick up trash, tidy up cabins).
- All equipment and inventory should be present and in working order (aside from any issues already reported).
- Fuel and water tanks should be refilled if that was the condition at check-in (unless you've arranged and paid for a different return condition, e.g., you pre-paid fuel or cleaning services).
- Check-Out Procedure: Participate in the check-out inspection with the Yacht Provider. It's in your interest to be present while they inspect the boat, so you both agree on any new damages or the lack thereof. If everything is okay, ensure that is documented and you get confirmation that your security deposit will be released/refunded. If there are damages, discuss them on site if possible.
8.5. Financial Liability for Damages:
- Security Deposit: As mentioned, before departure you will likely provide a refundable security deposit to the Yacht Provider. You understand that this deposit can be used to cover the cost of any damages or losses that occur during your charter that are your responsibility (or your party's). If damages exceed the deposit, you may be liable for the additional costs. Minor things like a lost fender or broken dish may result in a reasonable deduction, whereas major damage (e.g., a collision causing hull damage) could exceed the deposit and involve insurance claims.
- Insurance Deductibles: The Yacht Provider's yacht insurance might cover certain damages (like if you run aground and cause expensive damage, their insurance may pay after a deductible). Often, the security deposit amount equals the insurance deductible. If an insurance claim is filed, typically the maximum you'd lose is your security deposit (if you didn't act with gross negligence or willful misconduct). However, if you violated the charter agreement or laws (e.g., you were drunk, or you took the boat out in prohibited conditions), insurance might refuse coverage and you could be on the hook for the full damages. Always behave responsibly to ensure coverage.
- Indemnification: If you or your guests cause harm or damage to someone else or their property while using the yacht (for example, you hit another boat), you agree to indemnify and hold Boat4You harmless from any resulting claims or lawsuits (see also Section 9 on liability). This means you would defend Boat4You and pay any costs that result from your actions, because Boat4You is just the platform provider and not involved in the operation of the boat.
8.6. Additional Responsibilities:
- Travel Arrangements: You are responsible for getting yourself and your party to the designated check-in location on time. Boat4You and the Yacht Provider are not responsible if, for instance, your flight is delayed or you have travel issues that cause you to miss the charter start (cancellation rules would still apply in that case -- consider travel insurance).
- Pets: If you plan to bring pets, you must check the Listing or ask beforehand. Some Yacht Providers allow pets (sometimes for an extra fee or with a higher cleaning deposit), while others strictly forbid them. If unauthorized pets are brought, it could be considered a breach and subject to additional cleaning fees or cancellation.
- Prohibited Items: Do not bring items on board that are prohibited by the Yacht Provider or law. This can include firearms, fireworks, non-prescribed controlled substances, or even certain electronic devices that can interfere with navigation. If in doubt, ask.
- Etiquette: While not a "legal" requirement, remember that you are often in shared spaces (marinas, popular bays) -- observe good boating etiquette. Keep noise reasonable (especially at night), respect marine life (no littering, avoid anchoring on coral reefs), and be friendly to locals and other sailors. This ensures a better experience for everyone and upholds the reputation of Boat4You Users.
By adhering to these responsibilities, you'll help guarantee a smooth charter vacation for yourself and avoid potential penalties or conflicts. Yacht chartering carries a bit more responsibility than a typical hotel stay -- you are essentially in charge of a moving vehicle on the water -- but it's very rewarding when done right. If you're ever unsure about your obligations or how to do something (e.g., how to operate a boat system), don't hesitate to ask your Yacht Provider or Boat4You for guidance. We want you to be safe, confident, and happy on your voyage.
9. Liability and Disclaimers
This section is critical as it outlines the limitations of Boat4You's liability, as well as your liability and certain legal disclaimers. By using our Platform, you are agreeing to these limitations, so please read this carefully:
9.1. Boat4You's Liability as an Intermediary: Boat4You's role is to facilitate connections and transactions between Clients and Yacht Providers (as detailed in Section 4). Because we are not a direct provider of yacht charter services, we cannot accept liability for the actual charter experience. Specifically:
- Boat4You is not responsible for the seaworthiness, safety, or condition of any yacht listed on the Platform. That responsibility lies with the Yacht Provider.
- Boat4You does not guarantee that a Yacht Provider will fulfill their obligations in the Charter Contract (e.g., deliver the yacht on time, in the expected condition, or provide certain services). We vet providers to some degree, but we cannot ensure performance. Any breach of contract by a Yacht Provider is to be resolved between you and that provider, though we will assist in communication and dispute resolution if possible.
- No Warranty for Yacht Suitability: We make no express or implied warranties that any yacht will be fit for your particular purpose. While we hope every charter is enjoyable, specific expectations (such as a boat's speed, comfort in rough seas, suitability for a party or for fishing, etc.) are not guaranteed by Boat4You -- rely on the information given by providers and ask questions beforehand.
- Site Availability: We strive to keep the Platform up and running smoothly, but we do not guarantee uninterrupted or error-free access. Occasional maintenance, updates, or technical issues may render the Platform temporarily unavailable. Boat4You will not be liable for any indirect losses (like lost opportunity to book) due to Platform downtime.
- Third-Party Services: If you, through our Platform, engage any third-party services (like travel insurance offered via a link, or a provisioning service), those are outside of our control. We are not liable for the products or services of third parties, even if you learned about them through Boat4You.
9.2. Limitation of Liability: To the fullest extent permitted by law, Boat4You (including our officers, directors, employees, agents, and affiliates) will not be liable for:
- Indirect or Consequential Damages: This includes things like lost profits or revenue, loss of opportunity, loss of goodwill or reputation, or any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform or your charter. For example, if your charter goes awry and it ruins your honeymoon, we are not liable for the emotional distress or alternative costs (though we truly empathize).
- Direct Damages Cap: If, notwithstanding the exclusions, Boat4You is found liable for any claim arising from these Terms or the use of the Platform, our total liability to you shall be limited to the amount of fees you paid to Boat4You for the booking giving rise to the claim (or, if the claim is not related to a specific booking, €100 as a nominal maximum). This cap applies per incident or series of connected incidents.
- No Liability for Personal Injury or Property Damage on Charter: You acknowledge that sailing and boating activities carry inherent risks. Any injuries, illnesses, death, or property damage that occur during or as a result of your yacht charter are primarily the responsibility of the parties involved in the charter (the Yacht Provider, the skipper/crew, and you as the Client). Boat4You is not organizing the trip; you assume all such risks when participating in a charter. (We do, of course, require providers to have necessary insurance and safe practices, but accidents can happen.)
- Force Majeure: Boat4You is not liable for failures or delays in performing our obligations due to events beyond our reasonable control (force majeure events as described earlier: natural disasters, war, pandemics, government shutdowns, etc.).
9.3. Disclaimers of Warranties:
- Platform "As Is": The Platform and all its content and services are provided "as is" and "as available". Boat4You makes no warranty or representation of any kind, express or implied, regarding the Platform's accuracy, availability, or suitability for your purposes. For example, we do not guarantee that using our site will result in finding a perfect yacht or that every Listing is exactly as depicted (though we certainly require honesty from providers).
- Implied Warranties: To the extent allowed by law, we disclaim all implied warranties or conditions, such as implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. If your jurisdiction does not allow the exclusion of certain warranties, some of these disclaimers may not apply to you -- in such case, our warranties are limited to the minimum lawful extent.
- No Guarantee of Continuous Service: We do not warrant that emails, notifications, or communications from Boat4You will reach you without delay or that our site is free of viruses or other harmful components (though we take standard security measures). You should use up-to-date antivirus and security software on your devices as a precaution when using any online service.
9.4. Your Liability and Indemnification:
- Responsibility for Your Actions: You may be held liable for any harm, loss, or damage we (Boat4You) suffer as a result of your breach of these Terms or misuse of the Platform. For instance, if you post defamatory content and we get sued because of it, or if you bypass our Platform to book directly and that causes us loss of fees, you could be responsible for those losses.
- Indemnity: You agree to indemnify, defend, and hold harmless
Boat4You and its affiliates, and their respective officers, directors,
and employees, from and against any claims, liabilities, damages,
losses, and expenses (including reasonable legal fees) that arise out
of or relate to:
- Your use or misuse of the Platform or services.
- Your breach of any provision of these Terms or of any applicable law or regulation.
- Your violation of any rights of a third party (for example, if you infringe someone's copyright in content you posted, or you injure a third party during the charter and they claim Boat4You is responsible).
- Any claim made by a Yacht Provider or other third party against Boat4You due to your actions (e.g., you cause damage on a boat and the provider's insurance or the provider tries to claim against us --- you would indemnify us in such scenario).
- This indemnification obligation will survive termination of your relationship with Boat4You and these Terms.
9.5. Release: To the extent permitted by law, you release Boat4You from any and all claims or liability related to any product or service of a Yacht Provider or other user, any action or inaction of a Yacht Provider, including a Yacht Provider's failure to comply with applicable law and/or failure to abide by the terms of a Charter Contract, and any personal injuries, death, property damage, or other damages or expenses resulting from the charter. This release does not apply to any claims you might have against a Yacht Provider or other party --- those you can pursue directly against the party at fault (and we may assist by providing available contact information or records as needed).
9.6. Insurance and Coverage:
- Yacht Provider's Insurance: Most professional Yacht Providers carry hull insurance for the boat and liability insurance (often required by law). However, the specifics of coverage can vary widely (deductibles, exclusions, etc.). Boat4You does not verify each insurance policy's details. It's the Yacht Provider's duty to have appropriate insurance, and you may ask them for confirmation or what is covered. Boat4You does not provide insurance to you as a client --- we are not an insurance company or broker.
- Personal/Travel Insurance: We strongly recommend you obtain your own travel insurance or charter insurance. For example, travel insurance can cover trip cancellation, medical emergencies, personal accident while on vacation, and personal liability. Some insurers offer specific skipper's liability insurance or deposit insurance (to protect your security deposit). These are optional but can provide peace of mind. Any insurance claims process is outside the scope of these Terms.
- No Insurance by Boat4You: As a platform, we do not automatically insure your trip. Any insurance or protection product, if offered in the future, would be governed by separate terms.
9.7. Statutory Rights: Nothing in these Terms is meant to exclude or limit any statutory rights or warranties that cannot legally be excluded or limited for consumers. For instance, if consumer protection laws in your country provide certain guarantees (like services will be provided with reasonable care and skill), and those apply to our services, then those guarantees are not overridden by this document. We do not seek to exclude liability for gross negligence, fraud, or intentional misconduct by Boat4You or for any personal injury or death caused directly by our proven negligence. Those are areas where liability cannot be limited under many laws. However, in the absence of such circumstances, the limitations and exclusions above apply.
9.8. Legal Remedies: If you are dissatisfied with the Platform or Boat4You's services, or you believe we've breached these Terms, your remedy is first to notify us so we can try to resolve it (we genuinely aim to resolve issues amicably). If we cannot resolve it and you pursue legal action, it will be subject to the limitations of liability and governing law provisions herein.
In summary, while we at Boat4You stand behind our Platform and will do our best to assist you, we need to make clear that the actual yacht charter experience is managed by third parties (the Yacht Providers). By using Boat4You, you accept that division of responsibility. This clarity allows the sharing economy model to function -- and we thank you for understanding these boundaries. Should anything truly unfortunate occur, we will always try to support our Users within the capacity of our role, but we cannot assume blanket liability for all aspects of your trip.
10. Reviews and User Content
Boat4You encourages Users to share their experiences through reviews and other content. This section covers the rules and rights regarding any content you contribute to the Platform, including text, images, and feedback:
10.1. User-Generated Content: Our Platform may allow you (and other Users) to create or upload content such as:
- Reviews and Ratings: After completing a charter, Clients can leave a review and star-rating for the Yacht Provider and the boat. Yacht Providers might also review Clients in some systems (for internal use or to share with other providers).
- Profile Information: Yacht Providers might upload boat photos, descriptions, and their credentials; Clients might have profiles or avatars.
- Messages: Communications between Clients and Yacht Providers via our messaging system are also content, albeit private between the parties (and visible to Boat4You admins for safety and support reasons).
- Other Media: Occasionally, Users share photos or videos of their trips, or ask questions in community forums if such exist.
By submitting any content on our Platform, you confirm that:
- You Own or Have Rights: You either are the sole creator and owner of the content, or you have all necessary rights, licenses, and permissions to use it and to authorize Boat4You to use it as described below. For example, don't upload someone else's photo or a copyrighted text without permission. If multiple people are in a photo, make sure they're okay with it being posted.
- No Violation of Laws or Rights: Your content does not defame anyone, does not invade anyone's privacy, is not obscene or offensive, and does not infringe on intellectual property or other rights of any person or entity. It also must not violate any laws (e.g., hate speech or incitement to violence is forbidden).
10.2. Content Guidelines: We want reviews and other content to be helpful, honest, and respectful. By posting content, you agree to follow these guidelines:
- Truthful and Relevant: If you are writing a review, it should be based on your real experience. Don't exaggerate or fabricate events. Ensure your feedback is relevant to the yacht charter and service received. (For instance, it's fine to comment that "the boat was clean and as advertised, but the marina was crowded," but not relevant to rant about unrelated political opinions.)
- Respectful Tone: Avoid profanity, discriminatory remarks, or personal insults. Criticism is allowed (even negative reviews are important for transparency), but it should focus on facts and your personal experience rather than attacking someone's character.
- No Fake Reviews: You should not write a review for a charter you didn't take, and you cannot review yourself or a business you have an interest in. Also, you cannot pay or incentivize others to write biased reviews. We have systems to detect suspicious reviews and will remove content that we believe is fraudulent or conflicts of interest.
- Privacy Considerations: Don't include personal identifying information of other people in your public content. For example, don't post someone's full name, phone number, or address in a review. Use first names or roles ("the skipper," "the owner") rather than identifiable info. And do not post anyone's financial information or sensitive personal data.
- No Spam or Ads: Content should not be used to advertise unrelated products or services. For Yacht Providers, the boat listing is the place to "advertise" their boat; in reviews or other sections, we don't allow posting links or promos for other websites or businesses. Similarly, Clients should not use reviews or messages to push their own business interests.
- Photos/Videos: If you upload photos or videos (perhaps in a review or to your profile), ensure they are relevant (e.g., pictures of the boat, your sailing trip scenery). Do not upload graphic content, nudity, or anything that would violate decency standards or could harm the Platform's reputation. If others are in your photos, get their permission or make sure they're okay with being in a public post.
10.3. License Grant to Boat4You: By posting or submitting content to the Platform, you give Boat4You a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, and transferable license to use, copy, modify, distribute, publish, and display that content in connection with operating, promoting, or improving our services.
- For example, we may display your review on the yacht's listing page for others to read. We might use snippets of reviews or photos in marketing materials or social media to show real customer experiences. If you share a great photo of a sunset from your charter, we'd love to share it (with credit to you if feasible) to inspire others.
- This license lasts indefinitely (or at least as long as the content is protected by intellectual property rights). Even if you remove your content or delete your account, we might retain backup copies or archive records of it, and we're allowed to use any content that was already shared or distributed (for example, if your review was included in a newsletter, that copy stays valid).
10.4. Moderation and Removal: Boat4You does not pre-approve every piece of content, but we do reserve the right to review, monitor, and remove or edit user content at our discretion:
- We may remove content that violates these Terms, our content guidelines, or that we deem inappropriate for any reason. This could include reviews that appear to be fake, content with prohibited hate speech or harassment, or images that are not relevant.
- We also may disable your ability to post if you repeatedly violate content rules.
- However, we are not obligated to remove content that someone (including a Yacht Provider) may disagree with. For instance, if a Yacht Provider gets a negative review that is honest and within guidelines, we will not remove it just because it's unfavorable. Our goal is to maintain trust through genuine feedback.
- If you believe someone else's content (like a review about you or your charter) is false or violates these Terms, you can flag it or contact us with your reasoning. We will investigate and decide fairly, but our decision on content moderation is final.
10.5. No Endorsement of User Content: User content, such as reviews, is the opinion of the individual poster, not of Boat4You. We do not guarantee the accuracy of any review or statement made by users. While we may highlight certain reviews or respond to them, that does not mean we endorse their content. Use your judgment: a single bad (or good) review might not tell the whole story, which is why multiple opinions and overall ratings are useful.
10.6. Communication Channels: If the Platform includes forums, chat rooms, blogs, or social media integration, anything you post in those public areas is public. Even in the messaging system between Client and Provider, while it's private to you two (and our admin oversight), you should still be respectful and remember that written communications could be referenced in dispute resolutions.
10.7. Intellectual Property of Content: Other than the license you give us, you retain ownership of the content you post. Posting content does not transfer ownership to Boat4You. You simply give us and our affiliates permission to use it as described. If you believe someone is misusing your content or infringing on your intellectual property on our Platform, you can report it to us (e.g., if another user copied your photo or description).
10.8. Feedback to Boat4You: If you provide us with feedback, ideas, or suggestions about the Platform ("Feedback"), note that this is entirely voluntary, and we are free to use the Feedback as we see fit, without any obligation to you. You won't be owed any compensation if we implement an idea you suggested. We treat such Feedback as non-confidential and non-proprietary.
In summary, we value the content our Users contribute -- it adds richness to the community and helps others make informed decisions. Just keep it lawful, civil, and relevant. Boat4You will do its best to maintain a trustworthy content environment, balancing free expression with respect and safety.
11. Intellectual Property Rights
Boat4You respects intellectual property rights and expects Users to do the same. This section outlines the ownership of content and intellectual property on the Platform, and how you can and cannot use it:
11.1. Boat4You Platform Content:
- Ownership: All content provided by Boat4You on the Platform (excluding User-generated content discussed in Section 10) is owned by or licensed to Boat4You. This includes the overall website design, text, graphics, logos, button icons, images and videos we create, databases, software and code that runs the site, and compilations of content (like the arrangement of Listings or reviews). The Boat4You name and logo are our trademarks. All such materials are protected by copyright, trademark, and other intellectual property laws.
- Rights Reserved: Boat4You reserves all rights to its intellectual property. This means that except for the limited license granted to you below to use our services, we retain ownership and control over how our content is used.
11.2. Limited License to Users:
- Personal Use: Boat4You grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform and its content for your personal, non-commercial use related to the purpose of the Platform (i.e., to search for, evaluate, and book yacht charters or to list your yacht if you're a provider).
- What You Can Do: You may display our pages on your screen, download reasonable content for caching purposes, and print pages from the website for your personal use (for example, printing a Booking confirmation or a Listing detail to discuss with your travel companions).
- Mobile/App License: If we have a mobile app, for instance, and you download it, we give you a similar limited license to install and use one copy of the app on your device, solely to use the Platform for its intended purpose.
11.3. Prohibited Uses of Our IP:
Without explicit prior written permission from Boat4You, you must
not:
- Reproduce or Distribute: No copying, reproducing, distributing, or redistributing any portion of the Platform or its content to any other medium or website, except as allowed in 11.2 for personal use. For instance, you can't scrape our boat listings to create a competing service, or copy our text into your own website.
- Derivative Works: Do not modify, translate, adapt, or create derivative works based on the Platform content. This includes not taking our images or text and altering them to reuse elsewhere.
- Commercial Use: Do not use any content from our Platform for commercial purposes outside of the Platform's intended transactions. That means you cannot take information (like boat listings or user reviews) and sell it or use it to drive traffic to your own commercial venture.
- Trademarks: Do not use the "Boat4You" name, logos, or any trademarks or service marks appearing on the Platform without our prior consent. This includes not using our name in meta tags or hidden text for SEO, and not implying endorsement by us in any product or service you might be involved in.
- Frame or Mirror: You may not "frame" or "mirror" any part of the Platform on any other website or server. This means you can't embed our webpage in another site interface.
- Reverse Engineering: You cannot reverse-engineer or attempt to extract the source code of any software or database used in the Platform, except to the extent allowed by law (and if you need to for interoperability or other legal reasons, you must contact us first).
- Excessive Extraction: You should not systematically retrieve data or content from the Platform to create a collection or database without written permission. (Casual saving of a few pages for later reading is fine; running a bot to download every listing would not be.)
11.4. Yacht Provider Content: Yacht Providers often upload content such as boat descriptions, images, pricing info, and availability. They remain owners of that content but by providing it on the Platform they have given Boat4You the right to display and use it for the operation of the service (as covered in Section 10's license from users). As a User, you should not reuse a Yacht Provider's photos or text elsewhere without permission. Those could be copyrighted by the provider or photographer.
11.5. Copyright Infringement Claims:
- Boat4You respects copyright law, such as the U.S. Digital Millennium Copyright Act (DMCA) and EU copyright directives. If you are a copyright owner or agent and believe any content on our Platform infringes upon your rights, you can send us a notice requesting removal of the material. The notice should include identification of the copyrighted work, identification of the infringing material (with URL or specifics to help us locate it), your contact information, a statement that you have a good faith belief the use is not authorized, and your signature (physical or electronic). We will respond to valid notices by removing the infringing content and, if applicable, terminating the accounts of repeat infringers.
- Conversely, if content you posted was removed due to a claim and you believe it was wrongfully taken down, you can send us a counter-notice with similar details and we'll review it.
11.6. Ideas and Feedback: As mentioned before, if you send suggestions about our Platform (like how to improve features or new business ideas), you do so voluntarily and we have no obligation to keep them confidential or to pay you for them. Our development of similar ideas on our own or from other sources does not waive our rights.
11.7. Third-Party Intellectual Property: Sometimes our Platform might display content that is from third parties or links to third-party websites (like a blog that has a nautical article, or a link to a marina's site). We don't claim ownership of third-party content and all respective rights remain with their owners. If you use third-party sites or content, you are subject to their terms and should respect their IP rights as well.
11.8. Reservation of Rights: All rights not expressly granted to you in these Terms are reserved by Boat4You. This means if we haven't specifically said you can do something with our content or Platform, you should assume you cannot.
11.9. Termination of License: If you breach any of the Terms regarding use of our intellectual property, your permission to use our Platform automatically terminates. In addition, we may deny access to the Platform (like banning an account or IP) to those who infringe on IP rights.

If you love our brand and want to share it, you're welcome to share links to our site or talk about us, but don't misuse our content or violate rights. 12. Governing Law and Dispute Resolution
Boat4You is a Croatian company, and thus our legal relationship with you is anchored in Croatian law. This section explains how we'll handle disputes, what law applies, and where any disputes would be resolved:
12.1. Governing Law: These Terms and any separate agreements whereby we provide you services (and any disputes or claims arising out of or in connection with them) shall be governed by and construed in accordance with the laws of the Republic of Croatia, excluding its conflict of law provisions. We specifically choose Croatian law because it provides a consistent legal framework for our operations, even as we serve an international user base.
- If you are a consumer residing in the European Union, this choice of Croatian law does not deprive you of any protection you have under the mandatory laws of your country of residence. In other words, you may have certain consumer rights or remedies under your local laws (especially in the EU) that still apply to you and cannot be waived by this agreement.
12.2. Jurisdiction: You and Boat4You agree that any dispute, controversy, or claim arising out of or relating to these Terms, or the breach or validity thereof, that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts in Croatia. Unless otherwise required by law, the courts of the City of Zagreb (Croatia's capital) will generally be deemed the competent venue for any such disputes, given our company's expected principal place of business.
- Exclusive jurisdiction means you agree not to file a lawsuit against us in any other country's courts. Similarly, we will not file against you in other courts (except perhaps to enforce a judgment or if required dealing with property, etc., but primarily, Croatia is the forum).
- That said, if you are a consumer, there may be instances under EU law where you could choose to bring a claim in your home country's courts. The "exclusive jurisdiction" clause may not apply to a consumer in certain cases (for example, EU rules sometimes allow consumers to sue in their home courts under specific conditions). We mention this to be transparent, though our intent is to direct disputes to Croatia when possible.

Note, this is an option for you; it doesn't replace our agreement above about jurisdiction, but it's a tool that might help mediate a dispute out of court.
- Boat4You is not committed to using any specific ADR entity unless required by law, but we will review any suggestion of ADR in good faith.
12.5. Legal Expenses: In any litigation arising out of these Terms, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs, except where prohibited by law or where a different allocation of costs is provided by statute (for instance, some consumer protection laws allow consumers to recover fees if they win, etc.). This clause mostly applies business-to-business, but we include it generally; for consumers, a court might decide differently based on local laws.
12.6. Time Limit to Bring Claims: To the extent allowed by law, any claim or cause of action you might have arising out of or related to these Terms or use of the Platform must be filed within one (1) year after such claim or cause of action arose, or else be forever barred. This means if something happened, and you wait more than a year to take legal action, you will not be allowed to pursue it (again, this may not apply if a law mandates a longer period, but many general disputes would fall under this contractual limit).
12.7. Acknowledgment: You acknowledge that the purpose of this Section 12 is to provide predictability in our legal relationships and to potentially reduce litigation costs by choosing a familiar legal setting.
